1. Agreement To These Terms

These Terms & Conditions (the "Terms") govern your use of the Listing Wand website, apps, and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Please also review our Privacy Policy.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

2. The Service

Listing Wand helps people and teams selling land generate photorealistic, AI-assisted concept images for vacant land and acreage listings. The Service may allow you to upload a photo, choose a preset (such as structures or seasonal variants), and generate one or more output images.

The Service produces marketing concepts. Outputs may contain inaccuracies, artifacts, or unrealistic details. You are responsible for reviewing outputs and deciding whether to use them.

3. Eligibility, Accounts, And Security

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate account information and keep it up to date.
• If you believe your account has been compromised, contact us as soon as possible at support@listingwand.com.

4. Plans, Credits, And Billing

Some features require a paid subscription or the purchase of credits. Subscriptions and one-time purchases are processed by our payment provider (currently Stripe). By starting a paid plan or purchase, you authorize us (and our payment provider) to charge your selected payment method.

• Auto-renewal. Subscriptions typically renew automatically unless you cancel before the renewal date.
• Credits. Generating images consumes credits (or other usage units) as shown in the app. Credits have no cash value and are not transferable except as explicitly permitted by the Service (for example, within a shared team workspace).
• Included vs. add-on credits. Included credits may reset each billing cycle. Add-on credits (such as top-offs or promotional credits) may have separate expiration rules.
• No refunds. Fees are non-refundable except where required by law or as explicitly stated by us in writing.
• Changes. We may change plan features, pricing, or credit costs over time. If changes affect you, we will provide notice through the Service or as otherwise required by law.

5. Your Content (Inputs) And Generated Images (Outputs)

The Service may allow you to submit content such as photos, prompts, text, watermarks, logos, and other materials ("Inputs"). The Service may generate images and related content based on your Inputs ("Outputs").

• Your rights. As between you and Listing Wand, you retain any rights you have in your Inputs. Subject to these Terms, we also grant you a license to use Outputs for your lawful business purposes (for example, marketing a listing).
• Permission to process. You grant Listing Wand a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and process your Inputs and Outputs to operate, maintain, and provide the Service, including through our service providers.
• Your promises. You represent and warrant that you have all rights needed to upload and use your Inputs, and that your Inputs and your use of Outputs will not violate any law or infringe any third-party rights.
• Similar results. Outputs may not be unique, and other users may receive similar results.

You are responsible for how you use Outputs, including any required disclosures (such as "Artist Rendering" or "Virtual Staging") and compliance with MLS, advertising, and brokerage rules that apply to you.

6. Acceptable Use

You agree not to:

• Upload content you do not have the right to use, including copyrighted photos you do not own or have permission to process.
• Use the Service to create or distribute unlawful, harmful, deceptive, or misleading content, including images intended to misrepresent a property.
• Attempt to bypass usage limits, access controls, or credit enforcement, or interfere with the Service (including by scraping, probing, or attacking).
• Reverse engineer, decompile, or attempt to discover source code or underlying prompts/models except to the extent such restrictions are prohibited by law.

7. Third-Party Services

The Service may rely on third-party services such as cloud hosting and storage providers, payment processors, and AI model providers. Your use of those third-party services may be subject to their own terms and policies. We are not responsible for third-party services that we do not control.

8. Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or compensation.

9. Suspension And Termination

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, used the Service in a way that could create risk or harm, or if required by law. You may stop using the Service at any time.

After termination, we may delete your Inputs and Outputs consistent with our retention practices and applicable law. You are responsible for downloading and retaining any Outputs you wish to keep.

10. Disclaimers

THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." LISTING WAND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Listing visuals created with the Service are marketing concepts, not engineering or architectural documents. Listing Wand does not guarantee zoning compliance, permitting feasibility, buildability, utilities, access, setbacks, or any other real-world property condition.

11. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTING WAND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTING WAND'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO LISTING WAND FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Listing Wand from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your Inputs, your use of Outputs, or your violation of these Terms.

13. Changes To These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after changes become effective means you accept the updated Terms.
